TERMS AND CONITIONS

THE PURCHASE OF THE TICKET CONSTITUTES ACCEPTANCE OF THE FOLLOWING CONDITIONS:

These General Terms and Conditions regulate the services and/or products contained on the Website that, BURCOR PRODUCCIONES S.L., (hereinafter the Promoter), with CIF: B-7107295, domiciled at DS 363, 26500, Calahorra, registered in the Mercantile Registry of Navarra, General, offers to Users:

Tickets and wristbands:

Once a ticket has been purchased, its amount will not be refunded, except in the event of cancellation of the Festival, in which case Royal Decree-Law 11/2020, of March 31, adopting urgent complementary measures in the social and economic field to confront COVID-19, shall apply. Article 35 on consumer and user protection.

The ticket has different security measures. The Organization is not responsible for tickets not purchased from official sales outlets. Any ticket that is amended, broken, or shows signs of forgery will authorize the Organization to deny its holder access to the venue. The Organization reserves the right to take legal action. The Organization shall have the right to deny access to the venue to the ticket holder in case of detecting any anomaly in it.

The wristband has different security measures. The Organization is not responsible for wristbands not purchased from official sales outlets. Any wristband that is amended, broken, or shows signs of forgery will authorize the Organization to deny its holder access to the venue. The Organization reserves the right to take legal action. The Organization shall have the right to deny access to the venue to the wristband holder in case of detecting any anomaly in it.

Once your wristband has been sent, the wristband becomes the element that certifies the acquired right. Loss of the wristband will imply the loss of admission rights. Under no circumstances, and until the Festival ends, should you attempt to remove your wristband, as it would break and you would lose your right to access the venue. Keep your wristband when leaving the venue as you will need it to re-enter.

Only the attendee and ticket owner may request the replacement of a wristband due to loss or breakage. Except in the case where the event security personnel have canceled your wristband by exercising the right of admission. Replacement of a broken wristband with a new one will incur a cost of €20.

The handling fees applied by sales channels to the price of this ticket will not be refunded by the Organization under any circumstances, since the Organization is not the recipient of such amount and the provision of this service is deemed completed at the time of purchase of this ticket.

In the event of total cancellation of the Festival, the Organization undertakes to refund the price of this ticket, except for the amount relating to the distribution/management fee (GD).

Any claim must necessarily be accompanied by presentation of the ticket and the wristband.

Discounts: Any promotional code will have a maximum number of uses to prevent electronic fraud and subsequent massive and illegal resale of tickets. Unlimited use of discount codes will never be permitted for the reasons stated.

A ticket may be subject to a name change at a service cost of €10 + GD. Any ticket with a name change cannot be modified again. If an attendee has already entered the venue with a ticket/wristband, no name change will be allowed under any circumstances.

We check 100% of the wristbands leaving the factory and guarantee that none have been previously adjusted or tampered with. If a wristband shows signs of manipulation and you have not put it on your wrist, we must charge you €20 for the replacement of a new wristband.

In the event that you have received the wristband, the name change will be blocked and you must complete the name change authorization form (available on our website) in order to make the name change of your wristband at the festival box office.

Rights of the Organization:

The Organization reserves the right to alter or modify the program and lineup of the Festival.

The right of admission is reserved.

Flights with unmanned aircraft (drones) will be carried out for aerial filming before, during, and after the event. All persons in the venue will be considered participants in the aeronautical operation and will be deemed notified of the drone/UAS aerial operations, which will be carried out in the open category (subcategories A1, A2, and A3). Civil liability insurance is in place in case an incident occurs where the pilot is at fault. If an external person causes an incident or accident, the insurance will not cover possible damages. Legal action will be taken against the person responsible for the incident or accident.

The Festival Organization may deny access to or expel from the venue the ticket holder in case of non-compliance with the conditions imposed by the Organization’s staff, as well as in the event that it can reasonably be assumed that the person will create a risk or danger for themselves or other attendees, due to disorderly conduct or states of apparent or potential intoxication, the holder being personally liable in all cases for their own actions and omissions that cause injury to third parties or damage to property.

All attempts at fraud, trespassing, and/or damage to private property caused directly or indirectly to the Organization authorize it to take such legal actions, both civil and criminal, as it deems appropriate against those responsible.

The Organization reserves the right to modify, alter, or suspend the dates of the event, as well as to modify or cancel the content of these sales conditions at any time without the Organization incurring any liability towards purchasers or third parties, with the sole obligation of informing the attending public through the channels and/or media it deems appropriate.

Attendee Rights:

Upon entering the venue, the public may be subject to a search in accordance with current legal provisions, and entry of objects that may be considered dangerous by the Organization or are prohibited by current regulations will not be permitted, as well as professional photographic cameras, video cameras or recorders.

The attending public acknowledges and accepts that the Organization holds and owns all intellectual property rights, industrial rights, and any others, including image rights, derived directly or indirectly from the artistic performances or any other that take place during the celebration of the Festival, without territorial or temporal limitation, and with no other limitation than those provided by the current Intellectual Property Law. Consequently, the capturing, fixation, or recording of images or sounds without the prior written authorization of the Organization is strictly prohibited. The Organization may expel any person who breaches this obligation without entitling them to a refund of the ticket price.

The attending public may appear in images taken by different means for their subsequent dissemination through any media. The attending public at the event expressly authorizes, free of charge, the capture and fixation of their image, voice, and name for the purpose of allowing the maximum exploitation of recordings that may be made during the Festival and their subsequent dissemination by the Organization or by third parties authorized by it through any means of communication, expressly consenting to a promotional and/or commercial use of the captured images. Likewise, the attending public assigns to the Organizer, free of charge, the economic rights to their own image, without temporal or spatial limitation, for exploitation in any medium or by any means of communication, including their name in any type of advertising, promotion, publication (including Internet), or any other medium, even for promotional or informational purposes, as well as its exhibition in any medium and/or format.

In no case may the attending public claim any financial compensation from the Organization derived from the exploitation of such images.

Attendee Obligations:

Minors under 18 years of age may enter provided that they comply with the minors’ regulations specified on this page: Minors Policy. When entering accompanied by a responsible adult, this adult must ensure their safety and proper behavior during the Festival.

LOPD:

In accordance with the provisions of Organic Law 15/1999, of December 13, on the Protection of Personal Data, you are informed that your data will be included in a file owned by Burcor Producciones S.L. and may be used to manage your participation in the activities of Burcor Producciones S.L., as well as to keep you informed of matters relating to Burcor Producciones S.L. and to send you greetings by electronic means.

Capacity, Venue and Limitations:

The different areas of the different stages of the Festival have a legally established limited capacity, so once that limit is reached, access to such areas will be cut off. Consequently, the Organization will not in any case be responsible for the impossibility of certain attendees to access certain concerts or events that are part of the Festival.

No food or drink may be brought into the Festival venue. In case of medical necessity (celiac disease, etc.), a medical certificate must be presented.

It is important to note that some areas, such as the Ferris wheel and the VIP area, are not accessible to people with reduced mobility due to the lack of elevators.

Online Dispute Resolution Platform:

If you purchased the ticket to our event online and in the eventual case that it has not been possible to resolve an incident by contacting soporte@burcor.net or entradas@burcor.net, in accordance with Article 14.1 of Regulation 524/2013, of May 21, 2013, on online dispute resolution in consumer matters, we inform you that you have the possibility of resorting to an alternative dispute resolution entity in consumer matters accessible at the following address:

Payment System:

Holika will use the cashless payment system (wristband payment) at all festival stands and services, for which it will be necessary to top up the wristband and pay. This will be the only payment system accepted from June 25 to June 29.

On June 25, at the Welcome Party bars, payment will be accepted both by wristband and by credit card.

The wristband can be topped up with both cash and card at designated recharge stations and recharge totems.

Top-up bonuses and promotions: Any promotion that includes some type of bonus for topping up your wristband will not be refundable (neither the bonus nor the top-up amount).

A period of 30 calendar days will be established to request a refund of the remaining money on your wristband. The established period will run from July 7 at 12:00 until August 7 at 12:00. Once all requests have been received, refunds will begin to be processed on August 14.

The refund of the remaining money on the wristband will NOT entail the charging of any bank commission to the refund applicant.
Wristband Shipping:

A charge of €2.99 per ticket will apply, covering the cost of premium packaging and the express shipping service that we have implemented for Holika 2025. This fee also includes a possible return of your wristband package in case of repeated absence at the delivery address.

The shipping company (Correos) will attempt delivery twice. If unsuccessful, the package will be held at the nearest Correos branch for 7 calendar days. If the package with the wristband is not collected, it will be returned to our facilities.

To resend a package returned due to recipient absence, a cash-on-delivery fee of €3.75 will be charged to carry out the re-shipment of your wristband.

In case of modification of your wristband shipping address, contact us at entradas@burcor.net. Please note that no modifications will be made after 03/06/2025 as all wristbands will have been shipped.

We check 100% of the wristbands that leave the factory and guarantee that none have had the closure adjusted beforehand or been tampered with. If the wristband shows signs of manipulation and you have not put it on your wrist, we must charge you €20 for the replacement of a new wristband.

It is important that you put on your wristband on the day of the event and avoid excessive handling before wearing it. Any replacement needed due to manipulation, damage, or loss will incur a cost of €20.

You can wear the wristband on either wrist with the security closure properly adjusted. Our staff will check that the closure is correctly placed at access.

Any wristband whose ticket was purchased after 15/06/2025 must be collected at the box office, as there will not be enough time to deliver it by post to the purchaser.

Locker Conditions:

The reservation is only considered complete after we have received full payment and you have received a confirmation email with the details of your reservation.

A reservation through our online infrastructure entitles you to a locker of the chosen size. After completing the purchase, a locker cannot be exchanged for another size/combination of features.

Sales may be refunded on a case-by-case basis by contacting us and providing reservation details and the reason for cancellation.

Refund requests made more than 14 days after the order date will be considered non-refundable by default.

Cancellations of a reservation must be requested at least 14 days prior to the event, counted from midnight in the respective event time zone for which the cancellation was requested. Refund requests after this period will be considered invalid.

Refund requests will always be considered partial refunds. Administrative fees have been paid to initiate your reservation and process payment. These costs will be borne by the end user and therefore deducted from the refund amount.

The use of the locker during the reserved time is at the user’s discretion. No refund will be given for unused reservation days.
